Notice of Alleged Infringement
To be effective under the DMCA, a notice of alleged infringement must be in writing and must include all of the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright
- Identification of the copyrighted work claimed to have been infringed, or if multiple works at a single online site are covered by a single notice, a representative list of those works
- Identification of the material that is claimed to be infringing or the subject of infringing activity and information reasonably sufficient to allow us to locate the material
- Information reasonably sufficient to allow us to contact the complaining party, including a physical or email address, telephone number, and (if available) an electronic mail address
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
Notices that do not meet these requirements may not be effective and may not receive a response.
Counter Notice
If you receive a notice that material was removed or access was disabled because of an alleged infringement claim, you may file a counter notice with our designated agent. The counter notice must include:
- Your physical or electronic signature
- Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or disabled
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original notice or an agent of that person
Repeat Infringer Policy
It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of customers who are repeat infringers of copyrights or other intellectual property rights.
Misuse
Knowingly submitting a false notice or counter notice may result in liability under 17 U.S.C. § 512(f). We may refer false notices to legal authorities.
