What Information We Have
Depending on the customer and service, we may have:
- Subscriber information, such as name, billing address, service address, phone number, and email
- Service activation date and status
- Billing records and payment history
- IP address assignments and connection logs (retention periods vary)
- Voice service call detail records (CPNI, protected under federal law)
- Equipment information, including device identifiers
We do not record the content of voice calls or store customer internet traffic content. We do not have access to messages, content, or data stored by third party services our customers use.
What We Require
Subscriber information
We require a subpoena, court order, search warrant, or other valid legal process for subscriber information, except in genuine emergencies as described above.
Transactional records
Connection logs, IP assignment records, and similar transactional information require a court order under 18 U.S.C. § 2703(d) or a search warrant.
Voice call records (CPNI)
Call detail records and other CPNI are protected under Section 222 of the Communications Act. We require legal process appropriate to the level of information requested and consistent with federal law.
Content
Where applicable, the content of stored communications requires a search warrant. Real time interception requires a wiretap order under federal law.
Pen register and trap and trace
Pen register and trap and trace orders require a court order under 18 U.S.C. § 3123.
Customer Notice
Unless we are prohibited by law or a court order, we may notify the affected customer that we have received legal process for their information. If you require non-disclosure, include a request for delayed notice citing the applicable statute.
Cost Reimbursement
Federal law allows us to charge for the costs of compliance with legal process. We may invoice agencies for the reasonable costs of search, compilation, and production of records.
Preservation Requests
Preservation requests under 18 U.S.C. § 2703(f) should be sent to care@sumofiber.com. A preservation request is not a substitute for legal process. We will preserve responsive records for 90 days, extendable for an additional 90 days on request. Legal process must follow to obtain the preserved records.
Service of Civil Process
These guidelines are for law enforcement. For civil subpoenas, send to the address above and address them to SumoFiber's registered agent. Civil subpoenas for customer information must comply with state and federal law and may require advance notice to the affected customer.
Authentication
We may contact the issuing agency to verify the authenticity of legal process before producing records.
